Slip and Fall Lawyer Milwaukee, WI

As a slip and fall lawyer, our firm handles a broad range of slip and fall cases that involve grocery stores, schools, hotels, and shopping malls. Some have involved an icy entryway or floor with spilled liquids and others regarded alcohol-soaked bar floors, for example. A slip and fall can happen to anyone, anywhere, and at any time, especially at popular places like shopping malls.

Slip and fall accidents are common, but not all involve injuries. These incidents are most likely to occur when at  least one of the following apply:

  • Liquid was spilled on the floor
  • Food was spilled or left o the floor
  • Unknown debris was in your walking path
  • Too much mopping liquid was used
  • Too much degreaser or floor shiner was used on the floor
  • It was snowing or raining outside causing the entryways to become slippery

If you slipped and fell at a shopping mall you might assume the premise is liable for your injuries, but this is not always true.

When a Shopping Mall May Be Liable for a Slip and Fall

Following a slip and fall accident at a shopping mall, most people will naturally assume they can hold the owner responsible for their injuries. In truth, this is generally only applicable when:

  1. The shopping mall was aware of a potential hazard (i.e. spilled liquids)
  2. The shopping mall ignored the hazard
  3. Their ignoring of the situation led to you slipping and falling
  4. Had the shopping mall not ignored the hazard, you would have likely not fallen.

If the above applies, it may suggest negligence. In this case, the shopping mall owner could be held liable. To add to this, if the incident happened in a store rather than the mall hallways and open flooring areas, the store would be responsible – not the shopping mall. In other words, to hold the shopping mall liable for your slip and fall, the accident must have happened on their property rather than a store’s premises. If negligence was a factor and you were injured, it may be possible to file a claim for compensation for damages like medical bills, future medical treatment, lost wages, pain, suffering, and more.

Other Ways in Which A Slip and Fall Might Happen

Although most slip and fall accidents in shopping malls are the result of spilled liquid, there are other ways that these incidents can occur. One of these is in parking lots. There are many reasons why a slip and fall in a shopping malls parking lot could happen, including:

  • Poorly kept pavement
  • Debris
  • Weather conditions
  • Garbage
  • Puddles
  • Broken tiles just before the entrance
